136. The farm makes sure its workers know their obligations and rights related with their contracts with the company and current labor laws.

Means of verification:

Some of these documents are valid:

• Records of information delivered through e-mails, flyers, publications in bulletin boards and/or record of trainings related to the subject.
• Record of delivery of internal regulations document.

In the case of family farmers (AFC according to its initials in Spanish), if they subcontract services during the season, the company must have record of the above mentioned

137. The farm adheres and respects the pertinent laws regarding the labor rights of its workers.

Means of verification:

Documentation with work contracts, termination of employment documents, attendance list identifying gender records, payment of social laws that specify the following:

• It does not exceed the daily and weekly hours maximum.
• It does not exceed the extra hours maximum.
• It provides with breaks for lunch and rest.
• It gives payed vacations and sick leaves.
• It allows voluntary severance in specific cases.
• It uses transparent and just payment practices.

In the case of family farmers (AFC), if they subcontract services during the season, the company must have record of the above mentioned.

ACTION:

138. The farm promotes gender equity in its contract policy evidencing that there is not a specific gender request in its work offers.

Means of verification:

Some of these documents are valid:

• Hiring policy or procedure for the plant.
• Record of labor offers during the last year showing no specific gender requests.
